FREE LEGAL ADVICE TO MARY GRIFFITH, DAVE BELLIS AND WHOEVER OWNS WTAD RADIO

After five minutes of utterly failing to find a "convict" in Mayor Spring's contributor's list, mumbling about nursing homes and saying folks were "under investigation", (after a break for advertising and a farm report--adequate for texting from the loyalists) a person's name was trotted out as having been "convicted" of a DUI.

Mary, who was doing a fair job up until then, offered her own opinion that the claim was factual and Bellis was finally able to grunt out that was, in fact, who he was talking about (Never mind that he had earlier stated "convicts" in the plural and that he made specific reference to nursing homes.). They then identified this person's familial relationship to the the mayor.

The problem with that is this: even a cursory review of the regularly kept records of the courts around here would have yielded the fact that the gentlemen has never been convicted of SQUAT. He may be red meat for the local GOP but the facts are the facts.

Here's the advice: Run, do not walk, to the nearest word processor and microphone and get your apology out to this gentleman. It wouldn't hurt to ask him nicely not to sue your ass off, while you're at it. His family lawyer is really talented and knows how to spell "Defendant."

For future reference, Rule One: Look stuff up before engaging mouth.

Oh, and, Mary, next time let your guest answer the questions, or not, as he chooses. I know it was like interviewing a doorstop but wait for him to poop into his own mess kit.

This person was found guilty of DUI and speeding by Judge Slocum on 12-18-03. He was sentenced to 12 months supervision and payed $1218.33. He was discharged on 3-1-05. Yes, He was driving the Civic Center vehicle with M license plates when this occurred.

I noticed that Dave Bellis has had a couple of charges against him listed on the Adams County web site. Funny that we haven't heard anyone from his camp mention those. Hmmmmm?

Maybe you can explain the difference to me. Here's what Websters has to say about it.
GUILT: The fact or state of having offended: criminality and consequent liability to punishment.
GUILTY: Judged to have committed a crime.
CONVICTED: To have been decided in a law court that someone is guilty of a crime.
CONVICTION: The act of convicting, a verdict of guilty.
SENTENCE: Judgement passed on a criminal by the court or judge.
CRIMINAL: One guilty of a crime, a person who carries out a crime.
CRIME: A violation of the Law,an offense, something that is a wrong and can be punished by the Law.

Gee, so you're saying that our justice system really IS totally screwed up when "being found guilty" BY A JUDGE is not a "conviction".

That's some silly semantic games, to be sure.

I suppose what should have been said is "he was found guilty though he completed supervision so it's not a permanent part of his legal record--but he WAS found guilty."

2149,

Maybe it's because the Spring Campaign doesn't do chickenshit and Bellis serves three meals a day.

To the other three commenters;

My father-in-law had this little sign over his desk "DON'T FOOL WITH THINGS YOU DON'T UNDERSTAND"

Good advice.

Everything that happens in court is just conversation unless or until a court enters judgment. In cases of supervision, judgment is never entered and the case, in the end, is dismissed.

Find the most Republican lawyer you can find and ask 'em. This is basic. Your candidate made a fool out of himself because he was utterly unprepared.

She had a guest who wouldn't, or couldn't, answer a simple question: Who is the 'convict'? She had to go into a long break and multiple interrogation techniques.

The bottom line is that something untrue was said about a citizen who is not a candidate for anything.

We all know he was talking about two other guys and this was his fallback position. He shouldn't have shot off his mouth about "convicts" if he didn't want to answer the question. The first mistake was his. You can't blame that on the media.

Waterboarding Tookie? Really? Pretty funny considering it was your party that sacrificed cilvil liberties and due procees in the name of preventing terrorism.

And considering you run a blog and financially back an online news site that both specialize in taking pot shots at John Spring, you're a fine one to complain about the practices of any media member. Your candidate made an ass out of himself and now you're in full damage-control mode.

1514,

Your evaluation of DB performance is too kind. He'd have had to have done much better to get up to your overly kind ass-essment.

I just enjoy filling out FOIA's on a Sat . Mary is a raging liberal who lets any of the local Pols have a free pass . Word choice wasn't the best but oh well .

Spring takes money from Mike McClain and Durbin folks he should just stand by it . Instead he dances around for four years .

But where was the outrage in the last four years ? Funny it takes an election and Bob Gough shaming the media into doing their job .

What about the current cover up at hand in City hall ? How is that going to "play out"

I don't know.

Dave B's hesitancy and lack of knowledge (and mis-statement about a ma seems no worse to me than the Mayor's filibustering La Griffith's legitmate questions the week before.

I guess it all depends on whose ox is being gored.

1757,

That's a completely fair comment. You labeled it as your opinion and made a value judgment.

Far different from insisting something not so is so. Thank you for your view.

Here is a question .

Why does a word choice spark such "moral outrage" , yet the act they are defending was covered up ?

Do you think for a NY min that anyone but Radioactive could get away with a DWI in a City tagged car ?

So please hold the outrage folks .

I actually defended Mary for a bit , then decided she is about as biased as biased can get . It's her choice , free country and right now during an election cycle we must pick sides.

No matter which side wins , the sun will rise and set and life will go on .

Personally, I just don't care for the way the Bellis campaign is being run. Its been a very negative one from his end and apparently the things being said aren't even true. I also don't like the idea of presenting him as being all about change when it is pretty obvious that there are people pulling his strings and giving him things to say. Anyone who sees him try to talk in public is going to get that impression pretty fast.

Tookie,

The gentleman took his medicine in public just like so many other prominent citizens. What coverup?

You know the use of the word "convict" is inflammatory. Changing the subject to Mary (a whole 'nother kettle of fish)doesn't alter the fact that your guy behaved disreputably and got caught at it.

He couldn't make the murky nursing home thing stick, got a text message and descended on this local man. Sometimes weakness leads to evil results. Most of us don't know when we will face moral tests.

DB knew one was coming an still flunked it. Sad.

Oh UMR ,

We all have 'em. Bellis just knew his was coming and still whizzed it. That makes him willfully immoral instead of just weak.

Whether you like or don't like the person harmed is fundamentally beside the point.

A candidate for public office knowingly said something false about a non-public figure at an opportunity he knew was coming. Filthy. Irredeemably filthy.

Maybe not as filthy and false as yesterday's mailer, but still filthy.
