If we have learned something about the search for truth in the past 16 years, it has been despite Anita Hill and the proprietors of the newspaper that furnishes her column its forum today.

She gives us absolutely no reason to change our mind about her. She replies incredibly and unresponsively to the issues on the basis of which many concluded that her charges against Justice Thomas had been fabricated and leaked illegally for ulterior purposes by political assassins.

For many reasons (and I have discussed them in former iterations of this blog) I never thought she sustained her burden of showing sexual misconduct had taken place. I have never changed my mind. So, we probably have a common starting point.

Because I make arguments dealing with proven facts (even when they're inconvenient for my client), I am more interested in first the choice to make an argument that scratches an old scab off and the method in which it was made.

I thought she had the better of the argument about whether she was a mediocre performer. He hired her twice and wrote a recommendation for her to become a teacher at ORU Law School. No responsible lawyer recommends a mediorcre lawyer to teach emerging lawyers. It just doesn't happen.

On the issue of whether she was a "demure Christian", I don't know who got the better of the argument but it was a stupid track for him to open up. Any portent of knowing what is in somebody else's heart is usually a losing argument.

It's pretty simple to me. He doesn't make as much, being a judge, as he could otherwise and he had a million reasons to do it.

Whether she was "put up to it" in 1991 by "political assassins" I do not know (one insider who I know well says "no".) but the partisans damn sure adopted her.

I think I actually read the advanced chapter on Newsweek's web page, not NYT. Whatever the organ that made it available, that's all I've read.

Never have. I was a paraiah among some colleagues because I found the delayed reporting suspicious and the recitation inconsistent with the way professional employees relate SH.

Not the the entire Committee didn't behave like a bunch of untrained seals, they did. The "Character Witnesses" were stupid and the pattern witnesses were all, themselves delayed reporters. If anybody thinks that woman from Chicago with the strong personality would have sat still for SH and kept silent, they didn't see the same woman I did.

I didn't think either principal was telling the complete truth but I never thought anybody sustained any meaningful burden of prove showing that SH had taken place.

I do think it's kind of funny that, if she didn't want to be viewed as a lefty icon, she would go teach at, of all places, Brandeis.

Anyway, the short answer is no, never have.

I really can't add any more to the scab metaphor.

My impression at the time of the confirmation hearings was that there had been some causual sexual banter in the office. The particularity of Anita Hill’s stories was not likely invented. But the joking, in which she probably participated, was in no way harrassment. It only rose to that level when Ms Hill searched her memory for incidents that could be construed as damaging to Mr. Thomas’s nomination.

They did not rise to the level of SH even in her own mind at the time, or she would not have waited ten years, until the frantic anti-Thomas left needed some mud to bog down the nomination.

I pretty much agree with your second paragraph. You get a bunch of relatively young high achievers in an office environment with a lot of down time and some pressure and it can get a little randy. I also agree the best evidence of her belief that it didn't "rise to the level" is the delayed report.

We part company to the extent you profess or suggest she recruited by lefties. She was contacted by dem. staff initially, reported nothing. She called back and left a message and then was talked to by joint staff. Unless someone outside the Senate intervened, she was developed by the Senate's own established processes.

I think it more like her 15 minutes of fame.

Of course, none of that was my point in writing this common name spoof piece about the precious irony of the Thomases creating SH benchmarks on the same day.

I was at a funeral visitation tonight, somber uptight and at least five people come up to me and say what a yuck the Thomas thing was and how some commenters were kind of missing the point. That was a pleasant eye-opener!
