EEOC PROBLEM IN DUI INVESTIGATION

How come they're always testing for Horizontal Gaze Nystagmus?

When is Vertical gonna get some love?

What happens if a "suspect" would lay on their side to take the HGN test? Would the cops be required to still go horizontal with the object? Could you get that person dismissed?

Are they required to stand up straight and take the test? What if they refuse to do the tests? Do the cops still have probable cause?

Should one always refuse the breathalyzer?

I'm just fishing for your point.

Some say there is a constitutional problem with arresting people for being intoxicated, since they are being arrested for the increased potential to actually do some harm, despite how perfectly they might be driving. All of congress should be arrested by that logic.

I Was just having fun with the terminology. The Horizontal is kind of like the "Chinese" in "Chinese Taipei".

Yes, it is a stat-based crime and that is an interesting discussion.

A ton of folks were picking up autos at the Grove Inn today .

I was one of them and waved and smiled at other planners picking up their autos
